Visitor Visa

Visitors Visa A Visitor Visa is required for those intending to travel to the United States for a limited period of time for the purpose of business, pleasure or medical treatment. Applicants must demonstrate that they have a residence in India (or whatever your home country) which they do not intend to abandon, that they wish to enter the United States for a specifically limited period, that they will return to their home country and that the purpose of the trip is to enter United States for business, tourism or medical treatment.
There are two types of business visas:

  1. B1 is for business
  2. B2 is for pleasure (for tourism purpose)

  1. Business Visa (B1):
    If it is a business trip (B1 visa), a letter from employer requesting the Visa for the applicant addressed to consulate, indicating the purpose and length of the trip as well as the company's/ firm's intent to bear the costs of the entire trip, including lodging , food, medical and other expenses. Also provide the company's market and financial position with financial records, sources of funds, Tax papers and any News paper/press coverage or Advertisement brochures about the company.

  2. The Tourist Visa (B2)
    1. General information

    1. General Information

      Tourist visa is appropriate if you want to come to US for "pleasure". Many types of activities qualify under tourist visa, such as participating in conventions, conferences or convocation of fraternal or social organizations. Looking into potential colleges or universities, taking rest, visiting friends and family, taking part in amateur unpaid arts entertainment events or contests, attending short classes, receiving medical treatment, accompanying relatives on other temporary visas, all require a B2 visa.

      If your intention is to come to the US on tourist visa to look at schools, it is better to specify that at the time of application so that officer can put a notation in your visa stamp "Prospective Student". This is important to avoid any future problems where USCIS might say that studying was your true intention and not tourism, when you apply for change of status once you get admission into the school.

      If you are planning to attend short, recreational or part-time study course, it is better to specify that at the time of the application so that you can get "Study incidental to visit: I-20 not required" notation on your visa stamp to avoid any problems later.

      If you do not have a sponsor in the US but would still like to visit the US, you will have to follow the same process but you will not have to submit any sponsor related papers. However, you will need to show that you have a strong financial background. You can prove this by showing the last few years original tax return papers and deposit/pass book.

      Once the visitor is in USA, an additional extension of 6 months can be obtained upon approval by USCIS.



    2. Inviting your parents or relatives

      If you would like to invite your parents or relatives to visit you in the US, the process will be:
      • Send them the required documents
      • Set up an appointment for them for an interview. This can be done on the internet. Please visit the consulate sites for more info.
      • Attend the interview at the scheduled time. You will be told at the interview if you were granted the visa or not. If you have been granted the visa, you can pay at the counter there.
      • Your passport will be couriered to your address.

    3. Documents Needed:

      1. Completed and notarized Affidavit of Support form I-134. You can download it from US-INS web site.
      2. A letter from Bank/banks (on their business letter head), stating your account summary. (Talk to your bank and ask for your Account verification letter. Which is usually on the Banks office stationary should have the date your account was opened and current balance)
      3. Copy of your Bank Statement, showing a good balance. It should show that you are financially strong to support the visitor.
      4. Certificate Letter from your employer (on company's business letter head), stating that you are a permanent employee of the company, and also stating your salary.
      5. 1 or 2 recent pay stub copies.
      6. Copy of few recent income tax returns or last few W2 forms.
      7. If you are a Visa holder, Copies of your - Visa (H1/L1), H1 approval form (I-797), and I-94. (If visa has expired but has a renewed petition, photocopy of the renewed petition. If Green card Holder: Copy of green card. If USA citizen: Copy of certificate of citizenship. Which ever is applicable.
      8. A neat photocopy of your complete Passport, including the blank pages. Note: If you are sponsoring your in-laws, photocopies of all pages including blank pages of your spouse's passport and your marriage certificate is also required.

    4. The visitor needs to be prepared with the following documents for the interview at the consulate:

      1. Completed Non-immigration Visa application form DS-156, which is also available free of charge at the consulates only. (Separate for each visitor)
      2. Completed form DS-157, [ONLY required for for all male nonimmigrant visa applicants between the ages of 16 and 45]. (Separate for each visitor)
      3. Each applicant, including children of any age, must possess an individual passport valid for travel to the United States with a validity date at least six months beyond the intended period of stay.
      4. Two photographs 2 and 2 inches square (50 mm square) for each applicant, showing full face, without head covering, against a light background. To be used in the application Form. But please visit the US Consulate site to find out about the latest photo requirements.
        US consulates are very particular about the Photographs specification.
        Tip : Always keep some extra photos with you.
      5. Demand draft for *visa application fee.
      6. Demand draft or cash for visa issuance fee. Please see the Consulate’s web page for current visa rates.
      7. If it is a sponsored trip, all documents sent by your sponsor in USA (all original documents).
      8. Most important is to convince the consular officer that applicant has some bindings back in India/home country and that he/she will come back after his visit.
        The applicant must provide sufficient and convincing proofs and documents which supports his claim to return back and have no intention to stay in USA after the visa expires. To support this, one can provide the following documents, which can be helpful to convince the consular officer that he/she has strong ties to his/her country and is likely to return back.
        • Original property papers like house, shop or business ownership documents etc. which a person owns in India/home country. If no papers available make a notarized affidavit for the same.
        • Family bindings like unmarried children,old aged parents and other family responsibilities.
        • Original Bank statements/Passbook.
        • Fixed Deposite/ Share/mutual funds statments.
        • Tax returns statements if any.
        • If person is an employee, then show proof of employment and proof of leave grant from the office.
        • And any such document like an affidavit of assurance, that the visitor's intention is truly for visit and will be coming back, and have no intention to stay in US for a longer time.

      Applicants who want to visit the United States without a sponsor Applicants who are not being sponsored by any one and want to visit USA on their own must present credible evidence to show that they have sufficient funds. They must carry necessary financial evidence like bank statement etc which shows their financial position and can convince the consular officer.
