H1b Visa Stamping

green card H1b Visa Stamping Procedure:

In order to get h1b visa stamping with US consultate, you need to have the following things ready.

  • H1B approval Notice (Form I797)
  • H1B petetion application form (Form I129)
  • LCA (Labor Condition Application).
  • Employer support letter
  • Completed non immigration visa application form (Form DS-156); You can complete this online also.
  • Completed form DS-157.
  • An individual passport valid for travel to the U.S. If your passport will expire within six months, we strongly recommend you extend the validity prior to your interview date.
  • The originals, plus one copy, of your university diplomas, mark sheets and any certificates you may have. (Secondary school information is not required) Letter from petitioning employer confirming employer's intent to hire the applicant
  • Original, plus one copy, of your work experience letters from your previous employers
  • First time applicants may consider submitting the following documents:
    • Pay slips from current or most recent place of employment
    • Names and current phone numbers of the personnel managers at the applicant's present and past jobs
    • Photographs of the inside and outside of current or most recent employer's place of business
    • Names and contact information of two co-workers from your current or most recent place of employment
    • Names and contact information of two co-workers from past jobs
    • A complete resume/bio-data and cover letter describing current job duties in detail
    • Personal bank records for the last six months
    • US company information: photographs of the inside and outside of the company's offices, prospectus, brochures, and annual report

The Consulate will not accept documents received directly from the company; applicants must bring their own documents. If you are the beneficiary of a Blanket L petition, you must submit 3 additional copies of the I-797 and the I-129 forms with your application.

Important things to remember when filling out application forms:

  • Respond to all the questions. If you have no response for a question, put "none" or "nil" - do not draw a line or write "n.a." or "not applicable"If you fail to answer all the questions, this could create problems with your application, so remember to have an answer for each question.
  • Respond fully to each question. For example, No. 27 is "What is the purpose of your trip?" If you are going on a tourist visa to see your son who is working in Detroit, don't just put "tourist" as an answer, put " "going to visit son in Detroit". If you are a student, don't respond to "purpose of trip" with " to study", be specific - for example "going to study for B.E. degree at Louisiana State". Provide details whenever it is useful.
  • The applicant must sign the application, even if someone else fills it out.

H1B VISA fees and information:

  • Application Fees (Rs. 2205/US$45) [nonrefundable]
  • Issuance Fees (Rs. 3675/US$75)
Note: Demand Draft payable to AMERICAN CONSULATE GENERAL. Visa fees are subject to change due to the dollar/rupee exchange rate.

Application form OF 156:
Applicants for nonimmigrant visas who have been refused twice or more during a two-year period must make all subsequent applications by mail until the two-year period has expired. Mail applications should include applications forms, photographs, a demand draft for the visa application fee and copies of all relevant documents. If a mail-in application is judged to contain significant new information, the applicant will be invited to make another application in person

If your H1B stamping was refered to AFU (Anti Fraud Unit) you have to wait till the consulate consider your application and they will ask you to come in person to collect your VISA. Somtimes it may take 5-8 months for verification. You can call the consulate and find out the status of your application if you haven't received any updates from the consulate for a long time.
